Vehicle Lemon Laws

Author: Damian Sofsian

What if your newly purchased vehicle, whether it is a traditional automobile, a watercraft, or an RV, keeps exhibiting a problem that never goes away? As a consumer, are you supposed to just accept that there is a problem? What if the problem could potentially cause harm to you or your family? Shouldn't there be someone held liable for this problem?

Different states have different lemon laws to protect you as a consumer. The common factor in the law is that you are able to demand ample compensation, a full refund, or a replacement vehicle from the manufacturer. Though the law protects the consumer, it also protects manufacturers' rights. The law allows manufacturers to defend themselves and remedy the situations to the best of their abilities.

If you are filing a lemon law case, you need to file the complaint within a certain timeframe. Within that timeframe, the manufacturers are allowed to attempt to fix the problem. You need exhaust all efforts to fix the problem first before you can file a case. It is also important that the vehicle has been purchased for your personal use and not for business purposes.

It is important that you have met all the requirements in order before you try to file a case under the lemon law. It might be a good idea for you to acquire the services of a lawyer. Even if the lemon law does not apply to your situation, having a good lawyer might allow you to obtain due compensation for your vehicle's defects.
